Terms & Conditions

These Terms and Conditions (“Terms”) govern the use of this website and the purchase of goods and services from PackYolo (“we”, “us”, “our”). By accessing our website or placing an order, you agree to be bound by these Terms. If you do not agree, you must not use our website or services.

 

1. Acceptance of Terms

 

1.1 By browsing, accessing, or ordering from our website, you acknowledge that you have read, understood, and agree to these Terms.

1.2 PackYolo may amend these Terms from time to time. The revised Terms will apply immediately upon publication on our website.

 

2. Intellectual Property

 

2.1 All website content, including but not limited to text, graphics, images, and layout, is owned or licensed by PackYolo and is protected under Australian copyright and trademark law.

2.2 You must not reproduce, distribute, or adapt our content without prior written consent.

2.3 You warrant that any artwork, images, or content you submit for production do not infringe third-party rights.

 

3. Orders, Proofs and Cancellations

 

3.1 Proof Approval – Customers are responsible for reviewing all proofs carefully. We accept no liability for errors (including spelling, layout, die cuts, sizing, or images) once a proof has been approved.

3.2 Order Cancellations – Orders may only be cancelled before production commences. Cancellation fees will apply depending on the stage of production. Once goods have been dispatched, cancellations are not permitted.

3.3 Design Services – Fees paid for design services are non-refundable once an order has been placed.

3.4 Change of Mind – We do not accept returns or exchanges due to change of mind. 3D Samples are available to ensure suitability prior to placing bulk orders.

 

4. Artwork and Colour

 

4.1 Artwork must be supplied in CMYK format, minimum 300 DPI resolution. We are not responsible for errors such as blurriness, low-resolution, or colour shifts in files you supply.

4.2 Digital proofs cannot guarantee exact colour accuracy. Final printed colours may vary depending on printing processes, stock material, or finishes.

4.3 Hardcopy proofs are available upon request at an additional cost.

 

5. Materials Notice

 

5.1 Unless specifically stated otherwise in writing, PackYolo’s packaging materials are certified food-grade and can be used for direct contact with consumables.

 

6. Production and Delivery

 

6.1 Lead Times – Standard production is estimated at 10–14 business days from proof approval. Expedited production may be available at additional cost.

6.2 Shipping – Free standard shipping is provided within mainland Australia. Additional fees may apply for remote or rural areas.

6.3 International Orders – Customers outside Australia are responsible for customs duties, GST, and clearance charges.

6.4 Delivery Estimates – Delivery dates are estimates only. PackYolo is not responsible for delays caused by couriers, customs, weather events, or other circumstances beyond our reasonable control.

6.5 Incorrect Address – Additional fees will apply if goods must be re-shipped due to an incorrect address provided by the customer.

6.6 Public Holidays – Production and delivery may be delayed during national public holidays, including Australia Day, ANZAC Day, Labour Day, Christmas, Boxing Day, and New Year’s Day.

 

7. Returns, Replacements and Refunds

 

7.1 Customers must inspect goods upon delivery and notify us of any defects, damages, or shortages within 3–5 business days.

7.2 Returns must be pre-approved in writing. At least 95% of the order must be returned within 10 business days to qualify for a replacement or reprint.

7.3 Rush orders are non-refundable.

7.4 If approved, refunds will be processed within 5 business days of receipt of returned goods. Bank processing times may vary.

 

8. Quantity Variance

 

8.1 Industry practice permits up to ±5% variation in delivered quantities. If exact quantities are required, customers are advised to order 10% extra.

 

9. Indemnity

 

9.1 You agree to indemnify and hold harmless PackYolo, its officers, employees, and agents from all claims, losses, liabilities, damages, costs, and expenses arising from:

(a) your breach of these Terms; or

(b) any infringement of third-party intellectual property rights in content you provide.

 

10. External Links

 

10.1 Our website may include links to third-party websites for convenience. These links do not imply endorsement, and PackYolo is not responsible for the content, availability, or practices of such websites.

 

11. Limitation of Liability

 

11.1 Except as required by the Australian Consumer Law (ACL), PackYolo excludes all warranties, guarantees, and representations relating to the website, goods, and services.

11.2 To the extent permitted by law, PackYolo will not be liable for indirect, incidental, or consequential loss, including loss of profits, data, or business opportunities.

11.3 Nothing in these Terms limits your statutory rights under the ACL, including rights to remedies for faulty goods.



12. Governing Law

 

12.1 These Terms are governed by the laws of the State of Victoria, Australia.

12.2 Any disputes shall be resolved in the courts of Victoria, Australia.
